1. Introduction
1.1 ELFS Travel ("ELFS Travel") is a travel brand operated under Escape Low Fare Studio OPC Pvt. Ltd., a private limited company incorporated under the laws of India with its principal office at Block B1, Building-162, Third Floor, Vasundhara Enclave, New Delhi, Delhi 110096, India. ELFS Travel provides various travel-related services through its website www.elfstravel.com, mobile platforms, retail assistance channels, and customer support centre, with U.S. operations at 4820 Nationway Rd, Suite 110, Cheyenne, WY 82009, United States.
1.2 ELFS Travel provides Users (“User”) with travel-related information, pricing, availability and booking services for airlines, hotels, holiday packages, cruises, and car rentals across the United States and international destinations (“Services” or “ELFS Travel Services”). These Services are offered through various third-party service providers such as airlines, hotels, tour operators, DMCs and activity providers (“Service Providers”).
1.3 This Master User Agreement (“Agreement”) applies to all ELFS Travel Services. Depending on the service opted for by the User, additional Terms of Service (“TOS”) may apply. By using any ELFS Travel service, the User agrees to be bound by this Master User Agreement and the individual TOS applicable to each specific service. In case of any conflict between this Agreement and any Service-specific TOS, the Service-specific TOS shall prevail.
1.4 ELFS Travel Services are offered on the condition that the User accepts all terms, conditions and notices without modification. Using the Services constitutes acceptance of this Agreement, all applicable TOS, and any updates made from time to time. If the User disagrees with any part of the terms or notices, the User must not use ELFS Travel Services.
1.5 Service Providers may have their own terms that govern their offerings (airlines, hotels, packages, bus operators, etc.). The User is responsible for complying with all rules, fare conditions, policies and usage guidelines imposed by such Service Providers.
1.6 ELFS Travel reserves the right, at its sole discretion, to refuse any booking/order placed on the website without assigning any reason. A booking is considered confirmed only after full payment is received from the User and Escape Low Fare Studio issues a confirmation voucher/ticket/invoice.
2. Modification of Terms
ELFS Travel reserves the right to change, modify or update the terms, conditions and notices under which the Services are offered, including pricing, without prior notice. The User is responsible for regularly reviewing the updated terms.
3. Privacy Policy
The User acknowledges that they have read, understood and agreed to the ELFS Travel Privacy Policy. By accepting this Agreement, the User consents to receiving WhatsApp notifications, SMS alerts and emails from ELFS Travel regarding bookings, service updates, offers and support.
4. Limited User
4.1 The User agrees not to sell, trade, resell or commercially exploit any portion of the Services. ELFS Travel Services and the website are strictly for personal use only.
4.2 The User further agrees not to reverse engineer, modify, copy, distribute, transmit, reproduce, publish, create derivative works or sell any information, software, products or services obtained from the website. Limited reproduction is permitted only if ELFS Travel is cited as the source. Wholesale copying, modification or commercial use is prohibited.
5. Disclaimer of Warranties / Limitation of Liability
5.1 ELFS Travel endeavors to ensure accuracy of information but does not warrant the quality, completeness or accuracy of data. All services are provided on an “as is” basis without warranties of any kind.
5.2 ELFS Travel acts as a booking agent / facilitator on behalf of third-party Service Providers. It shall not be liable for quality of services, delays, service deficiencies, schedule changes or refund delays from Service Providers.
5.3 Descriptions, photos, timings, service details or pricing from Service Providers may change. ELFS Travel shall not be liable for human errors, data inaccuracies, supplier changes or refund delays. Refunds will only be processed after ELFS Travel receives such amounts from Service Providers.
5.4 ELFS Travel does not endorse advertisers or external websites linked on the platform.
5.5 Travel to certain destinations may involve risks. ELFS Travel shall not be liable for damages, losses, health hazards or safety risks.
5.6 – Maximum Liability Clause. In no event shall Escape Low Fare Studio be liable for direct, indirect, incidental, special, consequential or exemplary damages, including loss of profits, data or business arising out of use of Services. Escape Low Fare Studio's maximum liability is limited to the amount received from the User, minus cancellation or service charges.
6. Scope of Services
Service Provider. ELFS Travel (OPC) Pvt. Ltd., operating under the brand name ELFS Travel, shall provide travel-related services which may include (but are not limited to):
- Domestic & International Holiday Packages
- Hotel Reservations
- Visa Assistance
- Sightseeing Tours
- Local & International Transfers
- Customised Itineraries
- Ancillary travel-related support services
Service Execution. All services shall be provided based on written requests, confirmed quotations and payments received as per agreed timelines.
Third-Party Dependence. The Client acknowledges that several services (flights, hotels, visas, transfers, sightseeing, cruises, etc.) are fulfilled by third-party suppliers and remain subject to their terms, conditions and availability.
No Guarantee on Third-Party Decisions. ELFS Travel Studio does not guarantee outcomes such as visa approval, immigration clearance, room preferences, airline seat preferences, flight timings or operational decisions by external agencies.
Modifications & Updates. ELFS Travel reserves the right to modify itineraries, hotels, services, dates, timings and inclusions due to operational reasons, safety concerns, supplier policies or unavoidable circumstances.
7. Cancellation Policy
Full cancellation, refund and booking-change policies are available on our Help Center. All cancellations are subject to the terms and conditions of the respective airlines, hotels, visa authorities or service providers.
8. Disclaimer
All travel quotations, itineraries, fares and service descriptions communicated by ELFS Travel are based on information provided by independent third-party suppliers, including airlines, hotels, tour operators and visa authorities. While every effort is made to ensure accuracy, ELFS Travel does not provide any warranty regarding completeness, availability or error-free information.
ELFS Travel bears no responsibility for operational changes, cancellations, delays, baggage policies, visa outcomes or any unforeseen circumstances arising from third-party service providers.
